General terms and conditions

§ 1 Scope of Application

(1) These terms and conditions apply to the rental of accommodations as well as all additional services provided to the guest by Beachfront Villa Balaton.


§ 2 Contracting Parties

(1) The contracting parties are Beachfront Villa Balaton (hereinafter referred to as the "Host") and the guest. If a third party makes the booking on behalf of the guest, that third party shall be jointly liable with the guest to the Host as joint debtors for all obligations arising from the agreement. In case of doubt, the booking party shall be deemed liable even if the booking is made on behalf of or for specifically named persons. Regardless, each booking party is obligated to forward all relevant booking information, especially these General Terms and Conditions, to the guest.

(2) Persons using the accommodation are considered guests in the sense of these terms.


§ 3 Conclusion of Contract, Advance Payment

(1) The accommodation contract is usually concluded through the acceptance of the guest's written booking request by the Host.

(2) An advance payment may be agreed upon.

(3) The Host may require full prepayment of the total agreed amount.


§ 4 Commencement, Extension, and Termination of Accommodation

(1) Guests are entitled to occupy the rented premises from 3:00 PM on the agreed arrival date. There is no entitlement to earlier access.

(2) Reserved rooms must be occupied by 6:00 PM on the day of arrival. Unless a later arrival time is expressly agreed, the Host is entitled to reassign the accommodation after 6:00 PM without compensation to the guest. The Host thus has a right of withdrawal.

(3) If the guest has paid an advance equivalent to one night's stay, the accommodation remains reserved until 12:00 PM the following day.

(4) Any extension of stay requires the consent of the Host.

(5) On the agreed departure day, the guest must vacate the accommodation by 10:00 AM. The Host may charge up to 100% of the full lodging rate for use beyond this time, in addition to any resulting damages.

(6) If the contract was made for a fixed term, it ends upon expiration. Early departure does not entitle the guest to a refund; the Host is entitled to the full agreed amount.

(7) The Host may terminate the contract with immediate effect if the guest: (a) uses the premises in a significantly detrimental manner or behaves in a reckless, offensive, or grossly improper way, disturbing the peace of the surroundings or committing a punishable act against property, morality, or personal safety; (b) suffers from a contagious illness or one exceeding the duration of the stay, or becomes in need of care; (c) fails to pay the submitted invoice within a reasonable deadline after being requested to do so.

(8) If fulfillment of the contract becomes impossible due to force majeure, the contract shall be dissolved.


§ 5 Withdrawal from the Accommodation Contract

(1) Guest Withdrawal / Cancellation (a) In case of cancellation by the guest, the Host is entitled to reasonable compensation. (b) The Host may choose to charge a cancellation fee instead of calculating compensation in detail. (c) These rules also apply if the guest fails to occupy the accommodation without timely notice: Cancellation within 30 days before arrival: 50% of the booking price Cancellation within 14 days before arrival: 100% of the booking price

(2) Host Withdrawal (a) If an agreed advance payment or security deposit is not made within the specified period, the Host may also withdraw from the contract. (b) The Host may withdraw for valid reasons, particularly if the accommodation was booked based on misleading or false information (e.g. about the guest or the purpose of stay); if the Host reasonably believes the use of services could jeopardize operations, safety, or public reputation of the Host (without being attributable to the Host); if unauthorized subletting occurs; or if the Host becomes aware of significant deterioration in the guest’s financial situation. (c) In such cases, the guest is not entitled to compensation. (d) The Host may also withdraw if the guest fails to arrive by 6:00 PM on the arrival date unless a later time was agreed. (e) If a deposit was paid, the room(s) will be held until 12:00 PM the following day. (f) Even if the guest fails to use the reserved accommodation, they remain obligated to pay the full booking amount.


§ 6 Services, Prices, and Payment

(1) The guest is obliged to pay the agreed or applicable prices of the Host for the accommodation.

(2) Prices may be adjusted if the guest requests changes to services or length of stay, and the Host agrees.

(3) 50% of the total price is due immediately upon booking without deduction. The remaining 50% is payable no later than 30 days prior to arrival. In case of late payment, the Host is entitled to cancel the booking and withdraw from the contract.


§ 7 Host’s Liability

(1) In the event of service disruptions or defects, the Host will strive to remedy the situation upon prompt complaint by the guest. If the guest fails to report a defect, they forfeit the right to a price reduction.

(2) If a parking space is provided, this does not constitute a custody agreement. The Host is not responsible for surveillance. The Host accepts no liability for loss or damage to vehicles parked or maneuvered on the premises or their contents.


§ 8 Guest’s Rights

(1) Upon conclusion of the accommodation contract, the guest acquires the right to customary use of the rented space, facilities typically available to guests, and standard service.

(2) The guest is entitled to check-in from 3:00 PM on the agreed day of arrival.


§ 9 Guest’s Obligations

(1) The agreed amount must be paid via bank transfer. The Host is not obliged to accept non-cash means such as checks, credit cards, or vouchers.

(2) The guest must obtain prior approval before using any electrical devices beyond typical travel needs.

(3) Damage caused by the guest is subject to general liability law. The guest is liable for any harm caused to the Host or third parties by themselves, their companions, or others for whom they are responsible—even if the injured party claims compensation directly from the Host.


§ 10 Pets

(1) Pets are not permitted on the property.


§ 11 Final Provisions

(1) Any changes or additions to the contract, its acceptance, or these terms and conditions must be made in writing. Unilateral amendments by the guest are invalid.

(2) The competent local court for the Host’s location shall have jurisdiction over disputes arising from the accommodation contract.

(3) Diverging terms, including those in the guest’s or booking party’s general terms, do not apply unless expressly confirmed in writing by the Host.

(4) Hungarian law applies.

(5) Should any provision of these terms prove invalid or void, the validity of the remaining provisions remains unaffected. Statutory provisions apply in all other respects.
